Endless feeds, videos that start on their own, notifications that never stop buzzing — the European Commission thinks these aren’t just annoying habits of modern social media. They’re a legal problem. The regulator has preliminarily found that Meta breaches the EU’s Digital Services Act through what it bluntly calls “the addictive design of Instagram and Facebook”.

This is a preliminary finding, not a final verdict, but it puts two of the world’s biggest platforms squarely under the microscope. And the features it names are ones every user will recognize instantly.

The Commission’s investigation zeroes in on a handful of mechanics baked deep into both apps:

  • Infinite scroll — the bottomless feed that never gives you a natural stopping point.
  • Autoplay — video after video that keeps rolling whether you asked for it or not.
  • Push notifications — the steady drip of alerts engineered to pull you back in.
  • Highly personalized recommender systems — algorithms tuned to serve up exactly the content most likely to keep you tapping.

None of that is new to anyone who has ever lost half an hour to Reels. What’s new is the regulator’s framing. According to the EC, Meta “did not adequately assess the risks of its addictive design on the physical and mental wellbeing of users” — and it singles out minors and vulnerable adults as the groups most exposed.

That distinction matters. The Digital Services Act isn’t primarily concerned with whether an app is fun or sticky. It’s concerned with whether a very large platform has done its homework on the harms its design choices might cause, and whether it has taken reasonable steps to mitigate them. The Commission’s preliminary view is that Meta fell short on both counts — not by having a compelling product, but by shipping engagement-maximizing features without properly weighing what they do to the people using them.

The recommender systems sit at the heart of the concern. These are the engines that decide what appears in your feed, in what order, and how relentlessly. Personalization is the whole business model, but the EC argues that when those systems are optimized purely for time-on-app, the wellbeing of users — especially younger ones — can end up as an afterthought rather than a design constraint.

For Meta, a preliminary finding is a warning shot with teeth. Under the DSA, confirmed breaches can carry significant consequences, and the company now has the chance to respond and defend its practices before anything is finalized. For the rest of us, it’s a rare moment where the invisible machinery of the feed — the scroll, the autoplay, the ping — is being treated not as a neutral convenience but as a deliberate design decision with real accountability attached.

How Meta reworks these features, if it does at all, could reshape what scrolling through Instagram and Facebook feels like across Europe. And where the EU leads on platform design, others tend to follow.
